| SMART Online USER Agreement/Terms of Service SMART Recovery® On-Line exists for purpose of helping people recover from all types of addictive behaviors, including: alcoholism, drug abuse, substance abuse, drug addiction, alcohol abuse, gambling addiction, cocaine addiction, and addiction to other substances and activities. It does this by teaching a set of self-help concepts, tools and methods. SMART Recovery® On-Line also provides a supportive on-line environment in which to learn how to use and apply those concepts, tools and methods. SMART Recovery® On-Line is privately owned. Membership and participation in SMART Recovery® On-Line are completely voluntary. It is a privilege, not a right. SMART Recovery® On-Line services include message boards,chat rooms and or any other venue provided by SMART Recovery® On-Line which allow you and other users and participants to post information, provide feedback to SMART Recovery®, and interact in real-time. Please keep in mind that this recovery site addresses a variety of addictive behaviors, including individuals endeavoring to overcome sexually maladaptive behaviors. What might appear to be “fun banter” to you may be offensive to others. Please avoid sexually-oriented posts on the message boards, chat and meetings. Publicly denouncing SMART Recovery®, the Board of Directors of SMART Recovery®, the President or Executive Director SMART Recovery® the Director of SMART Recovery® On-Line, the Moderators or Administrator can lead to your being placed on moderation or banned from the SMART Recovery Message board. No advertising or soliciting of any kind for any reason is allowed on the Message Board, in Chat or in meetings. Please do not ask for gifts, donations, contributions etc, either for yourself or on behalf of others. The only exception is that Fund Raisers for SMART Recovery®, are allowed. You will be responsible for, and indemnify and hold harmless SMART Recovery®, its subsidiaries, divisions, affiliates, agents and representatives against, any claim arising from any material that you post or transmit. SMART Recovery® and its volunteers and members, may from time to time monitor or review discussions, chats, postings, transmissions, message boards and other user and participant generated pages on the Site, neither SMART Recovery® nor its affiliates is under any obligation to do so. You acknowledge that SMART Recovery® and its affiliates do not control the information available on the message boards, chat rooms and that any opinions, advice, statements, services, offers or other information or content presented or disseminated on any message board, chat room are those of their respective authors who are solely liable for their content. SMART Recovery® and its representatives reserve the right, in their sole discretion, to edit, refuse to post or remove any material submitted to or posted on the chat rooms and message boards. At no time will the public posting of any private topics (Pt's) or private e-mails without the original writer's consent be tolerated. Doing so is grounds for immediate moderation. Your use of the Service and the web facilities is at your own risk. Neither SMART Recovery®, nor any members, volunteers, divisions, affiliates, agents, or representatives shall be liable to you or anyone else for any loss or injury or any direct, indirect, incidental, consequential, special, punitive or similar damages arising out of your access or use of, or your inability to access or use, the service and the sites and the information available on the service and the sites or arising out of any action taken in response to or as a result of any information available on the service and the sites. You hereby waive any and all claims against SMART Recovery® and its members, volunteers, divisions, affiliates, agents, and representatives arising out of your use of the service and the sites and the information available thereon. You should be aware that if you voluntarily disclose personal information (e.g., user name, email address) on a message board, chat room or on any other user or member generated pages, that information can be collected and used by others and may result in unsolicited messages from other parties. You agree to never give your password to another person or participant, for your protection and for validity reasons. You also agree to never use another participant's account to post messages or browse this forum. A valid email is required to register on SMART Recovery. After you register and log into The SMART Recovery Message Board, you may fill out a detailed profile. (If you so choose -- it is not a requirement.) It is your responsibility to present clear and accurate information. Any information deemed inaccurate or vulgar will be removed. Multiple accounts on SMART Recovery message board are not permitted without prior approval of the Admins. If you are having technical problems please contact the Admins prior to registering a new account. Any participant found to have more than one account will be moderated. Moderated participants found creating additional accounts will be banned. All posts on the Message Board becomes the property of SMART Recovery. Nothing will be used outside of SMART Recovery without the explicit consent of the poster. If you decide to leave SMART Recovery On-Line, please do not ask for your posts to be deleted as this will not be done. Termination of your account: you may choose to not use the SMART Recovery message board but at no time will we delete your information to include posts and or your user id. Violation of this USER Agreement can result in "moderation" or being banned. Moderation includes your message board posts being reviewed prior to posting by an Admin. The use of the private topic and the SMART Recovery chat room will be removed during moderation. SMART Recovery reserves the right to modify User Agreement/Terms of Service at any time without notice. Your continued use of the SMART Recovery constitutes your acceptance of the revised Agreement/Terms of Service. Participants at SMART Recovery are responsible for reviewing SMART Recovery User Agreement/Terms of Service. Please periodically review this page for updates, to ensure that you are familiar with the most current version of our User Agreement/Terms of Service. This User Agreement and any disputes arising out of or related to the Service and the Sites shall be governed by, and construed and enforced in accordance with, the laws of the State of Maryland.
